These Terms of Service (“Terms”) govern your use of Andrivex (the “Service”). Andrivex is currently available at analyze.habilink.com and will be available at andrivex.com. These Terms apply to the Service regardless of the web address at which you access it. The Service is operated by HabiLink LLC (“we,” “us,” “our,” or “HabiLink”). By accessing or using the Service, you (“User” or “you”) agree to be bound by these Terms. If you do not agree, do not use the Service.

HabiLink LLC is located at 4930 Campus Drive, Newport Beach, CA 92660.

These Terms apply only to Andrivex. They do not apply to the separate HabiLink introduction platform, which has its own terms.

1. Description of the Service

Andrivex consists of two tools. The free calculation tool (the “Calculator”) provides a free public calculation. The paid analysis tool (the “Analyzer”) is a paid analytical tool that calculates, models, compares, explains, and stress-tests real estate deal economics based on assumptions you enter. The software analyzes the property and your assumptions; you make the transaction decision.

It does not provide legal advice or tax advice. All calculations depend on your assumptions and may differ materially from actual results. You are solely responsible for your transaction decisions and for verifying all inputs. Some content in this analysis may be generated or assisted by artificial intelligence; AI-generated content describes mathematical relationships only and is not professional advice, a transaction recommendation, or a guarantee of results.

This disclaimer may be displayed in full or as a short-form link that directs you to the complete text on the Service. A short-form version reading “Educational and analytical tool — not a broker, adviser, appraiser, attorney, or tax professional. See full disclaimer.” may be used next to individual figures, with a hyperlink to the full text.

3. Purchase Terms

3.1 What You Get

The Analyzer offers a one-time analysis for $9.00 per deal address. The $9.00 payment includes:

• One deal analysis
• Up to three (3) analysis versions per deal address
• A PDF report that can be emailed to a recipient

The Calculator does not require payment and provides the calculation only.

3.2 Price

The price is $9.00 per deal address, payable in full before the analysis is generated. There are no recurring charges, subscriptions, or automatic renewals.

3.3 Three-Version Limit

Each $9.00 purchase entitles you to a maximum of three (3) analysis versions per deal address. After three versions, you must purchase a new analysis for the same or a different deal address.

3.4 Refund Policy

The $9.00 fee is non-refundable, except in the following circumstances:

• Where a refund is required by applicable law
• Documented billing errors
• Duplicate charges
• Material platform failure (for example, the paid analysis or report could not be generated, the system erroneously prevents access to a purchased analysis, or the system erroneously limits the number of analysis versions)

Refund requests for these specific grounds may be submitted to support@habilink.com. The remedy (refund, credit, or restoration of access) is at HabiLink’s reasonable discretion.

No outcome-based refunds are offered. The Service is an analytical tool, and modeled results are not guarantees of actual performance. You are solely responsible for your transaction decisions.

3.5 Agreement at Checkout

Before completing your purchase, you must check an unchecked box confirming that you have read and agree to these Terms and the Privacy Policy. The payment button will be disabled until you check the box.

4. AI-Generated Content

Some content in the Service may be generated or assisted by artificial intelligence (AI). AI-generated content is labelled as AI-generated within the Service. AI-generated content:

• Describes mathematical relationships based on your inputs
• Is not professional advice, investment advice, legal advice, or tax advice
• Is not a transaction recommendation or guarantee of results
• Must not be relied upon as the basis for any transaction decision

You acknowledge that AI-generated content may contain errors. You are solely responsible for verifying all information independently.

5. Not a Real Estate Broker

The Service is not a real estate broker, real estate salesperson, or mortgage loan originator. The Service does not represent you in any transaction. The Service does not sell, buy, solicit, negotiate, list, or facilitate the purchase, sale, or exchange of any real property. The Service does not submit offers, communicate counteroffers, or coordinate closings. The Service does not receive compensation based on any real estate transaction. The Service does not act “for another” in any real estate transaction.

6. Not an Investment Adviser

The Service does not provide individualized investment advice. The Service does not recommend whether you should buy, sell, or proceed with any specific real estate transaction. The Service does not determine whether any investment is suitable for you. You establish your own investment criteria. The Service compares calculated results against your defined criteria only and does not suggest what those criteria should be.

7. Not an Appraiser

The Service does not perform appraisals, broker price opinions, or comparative market analyses. Any property values used in calculations are entered by you. The Service does not independently determine the market value of any property.

8. Not a Lender or Mortgage Broker

The Service does not originate, solicit, arrange, procure, negotiate, or approve any loan. The Service does not take loan applications or offer or negotiate loan terms. Any lender-oriented metrics displayed in the Service are based on your entered assumptions only. The Service does not match borrowers with lenders.

9. Not Legal or Tax Advice

The Service does not provide legal advice or tax advice. Educational definitions of real estate terms are not legal advice. The Service does not recommend specific contract provisions, contingency clauses, or legal strategies. You should consult licensed legal and tax professionals for advice specific to your situation.

10. Your Responsibilities

You are solely responsible for:

• The accuracy of all inputs and assumptions you enter
• Your transaction decisions
• Verifying all information independently
• Complying with all applicable laws, regulations, and licensing requirements in your jurisdiction

You acknowledge that real estate investments involve risk of loss and that modeled outcomes are not guarantees of actual performance.

11. Prohibited Uses

You shall not use the Service to: (a) engage in real estate brokerage activity without required licenses; (b) represent that the Service’s outputs are appraisals, broker price opinions, or professional valuations; (c) use the Service to provide investment advice to third parties; (d) use the Service to solicit buyers or sellers of real property; (e) use the Service to negotiate or facilitate any real estate transaction; (f) attempt to reverse engineer the calculation engine; (g) use the Service in violation of any applicable law, regulation, or licensing requirement; or (h) rely on AI-generated content as a substitute for professional advice.

12. Intellectual Property

The Service, including software, calculations, formulas, interfaces, educational content, and reports, is owned by HabiLink LLC. You retain ownership of your own deal data, assumptions, and custom criteria. You may not reverse engineer, copy, modify, distribute, or create derivative works from the Service except as expressly permitted by HabiLink.

13. Google Maps

This Service uses Google Maps Platform services, including the Places API, for address autocomplete and standardization. By using the address features of the Service, you acknowledge that:

• The Service includes Google Maps features and content.
• Your use of Google Maps features and content is subject to the then-current versions of:
  • The Google Maps End User Additional Terms of Service; and
  • The Google Privacy Policy.

Google collects and processes certain data (including search terms, IP addresses, and geographic coordinates) in connection with the Google Maps services. Google acts as an independent controller for this data, as described in Section 3 of the Privacy Policy.

14. Account Registration

The Analyzer requires account registration. You must provide accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activity under your account. You may not share account credentials with others.

15. Report Email

The Service allows you to email a PDF report to a recipient. When you use this feature:

• Your name and email address are visible to the recipient
• The email is a commercial message
• The recipient may opt out of receiving future emails from the Service
• Opted-out recipients are never emailed again

16. Limitation of Liability

To the maximum extent permitted by law, HabiLink LLC shall not be liable for any damages arising from your reliance on Service outputs, including but not limited to financial losses, transaction outcomes, investment decisions, loan decisions, or any consequential, incidental, special, or indirect damages. The Service is provided “as is” and “as available” without warranty of any kind.

17. Disclaimer of Warranties

The Service is provided without warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or reliability. All calculations are based on your entered assumptions and may contain errors. The Service does not warrant that results will match actual outcomes, that the Service will be uninterrupted or error-free, or that defects will be corrected.

18. Indemnification

You agree to indemnify and hold harmless HabiLink LLC, its officers, directors, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your transaction decisions, your reliance on Service outputs, or your violation of these Terms.

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association in Los Angeles, California. You waive the right to participate in a class action.

20. Modifications

We may modify these Terms with reasonable notice. Continued use of the Service after modifications constitutes acceptance of the revised Terms. Material changes will be communicated via email or in-app notification.

21. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
